In 2002, then Provost Spear announced the approval and implementation of the UW–Madison Domestic Partner Policy and a related document, the UW–Madison Declaration of Domestic Partnership form. Governance bodies representing students, classified non-represented staff, academic staff, and faculty approved the policy.

The intent of the Domestic Partner Policy is to simplify and clarify the documentation necessary for domestic partners of UW–Madison students and employees to obtain access to services such as housing, recreational sports facilities, and libraries. The policy and Declaration of Domestic Partnership form for access to these services should be used for these services only.

In 2009, the State Legislature approved the provision of health insurance benefits to same sex and opposite sex partners of state employees as of January 1, 2010.
